1. INTRODUCTION
These General Contract Conditions are an integral part of the contract stipulated between the CUSTOMER and GECO S.R.L.
2. RESERVATION AND CONCLUSION OF THE CONTRACT
The contract between the CUSTOMER and GECO S.R.L. will be concluded with the reservation made online, verbally or in writing. From that moment on, the rights and obligations arising from the contract and from these General Conditions will become effective for both the CUSTOMER and GECO S.R.L. If the CUSTOMER does not pay the total rental price within the terms and times established in the booking confirmation, GECO S.R.L. may refuse its services. GECO S.R.L. agrees to forward to the owner any changes requested by the CUSTOMER at the time of booking, but cannot in any way guarantee satisfaction. Special requests, as well as reservations subject to conditions and ancillary agreements concluded only verbally are valid only if confirmed in writing by GECO S.R.L.
3. PRICES
3.1 RENTAL PRICES
Unless otherwise indicated, the published amounts refer to the daily prices for the rented property based on the indicated period. The published prices are valid until the web page is updated. With the exception of point 3.6 (“Price changes”), the prices valid at the time of booking are decisive. The rental price does not include additional services requested by the CLIENT and, more generally, all items not expressly indicated in the booking confirmation. The price due for these services must be paid on site. As a rule, the minimum stay is seven days, with departure and arrival from Saturday to Saturday (unless otherwise indicated in the property description). Exceptions may be granted by written confirmation from the booking office.
3.2 ADDITIONAL COSTS
The prices include the normal consumption of energy, water and gas, unless otherwise indicated on the property description page. Any variable costs, which depend on the number of travellers or the composition of the travel group (e.g. tourist tax), are to be paid to the owner or his representative.
3.3 HEATING
Given the energy supply situation and the laws in force, the use of heating (switch-on period, switch-off period, temperature) is regulated by provisions that vary from region to region. Indicatively, heating systems can operate from November to April. Consequently, even when the cost is included in the rental price, heating must be considered usable in the same period.
3.4 CLEANING
The description page of the object will indicate whether final cleaning is included and any specifications. If it is not, the cost of cleaning will be indicated and the CUSTOMER is required to pay the owner or his representative the amount in EURO relating to cleaning of the accommodation. This amount does not include the removal of rubbish, which is the responsibility of the CUSTOMER. In the absence of this, the owner will be required to charge an extra cost in addition to what is due.
3.5 DEPOSIT
The description of the accommodation and the booking confirmation will indicate whether the CUSTOMER must pay the security deposit, in cash, in EURO, to the owner or his representative, when collecting the key. This deposit will be returned to the CUSTOMER upon departure after deduction of any damage caused to the accommodation and any additional costs not included in the rental price. The return of the security deposit does not extinguish the owner's right to compensation for any damage. The owner or his representative will refuse entry to the accommodation to the CUSTOMER who has not paid the security deposit, where required. If a CUSTOMER leaves early, the owner or his representative is authorized to return the security deposit (minus any damage and additional costs) only after having inspected the accommodation. GECO S.R.L. declines any responsibility in the event of disputes regarding the security deposit, between the CUSTOMER and the owner.
3.6 PRICE CHANGES
The objects have been described and the prices calculated with great care. However, changes in the services and/or price cannot be excluded. Such changes will be communicated to the CUSTOMER at the time of booking, at the latest in the booking confirmation. Price changes after the conclusion of the contract are unlikely, but cannot be completely excluded. In the event of a substantial change in an essential element of the contract, the CUSTOMER will have the right to withdraw from the contract, free of charge, within five days of receiving the communication concerning the change. In this case, the amounts already paid will be refunded to the CUSTOMER without delay.
4. PAYMENT
TI
The rental price due for the booked object must be paid before departure and specifically according to the following terms: 50% of the rental price must be paid at the time of booking. The balance must be paid to GECO S.R.L. no later than 44 days before the start of the rental. If the booking is made at short notice, less than 45 days before the start of the rental, the entire rental price will be due immediately upon booking and must be paid to GECO S.R.L. at that time. If the balance or the entire rental price (in the case of a short-term booking) is not paid within the established terms, GECO S.R.L. may refuse to provide services.
5. CANCELLATIONS
Cancellation by the CUSTOMER of a reservation, even if replaced by another, involves the payment of the following penalties:
- if the cancellation occurs within 42 days of the start of the rental, the deposit paid at the time of booking will be retained as a penalty;
- if the cancellation occurs after this deadline or in the event of a no-show, the CUSTOMER must pay the entire amount of the reservation.
The date of receipt of the cancellation notice by the GECO S.R.L. reservations office (fax: +39 055 2399124, e-mail: reservation@vacation-rentals.it) is authoritative.
Unlike what is stated above, the renouncer CUSTOMER has the right to be replaced by another person, provided that binding notice is given to GECO S.R.L., as the travel organizer, before departure, in good time so that the necessary changes can be made. The substitute must also satisfy all the requirements of the trip and no rule or legal provision must prevent the substitution. With the confirmation of the change of name by the travel organizer, the transferee CUSTOMER takes over for all purposes from the transferring CUSTOMER.
GECO S.R.L. has the right to withdraw from the contract before the start of the stay or to cancel the contract after the start of the stay without notice, if the CUSTOMER, despite the warnings, disturbs the progress of the stay or otherwise contravenes the terms of the contract with his behavior. In this case GECO S.R.L. is not required to reimburse the price of the stay.
- LOCKDOWN CANCELLATION POLICY
If the tenant (the person in whose name the reservation is made, to whom all correspondence is addressed, and, as such, the person responsible for the reservation) is unable to travel due to an official lockdown in place at the time of arrival characterized by the closure of borders or regional borders in the country of origin or destination, starting from 14 days before the arrival date it will be possible to cancel the reservation without any penalty. As a consequence of this, the tenant will receive a full refund via the payment method previously used to book or a voucher of the same amount to be used for a future reservation. This applies to all reservations confirmed from January 14, 2021 with arrival between January 14, 2021 and December 20, 2021.
6. LIABILITY
Should unforeseen events or cases of force majeure make it necessary, GECO S.R.L. may assign the CUSTOMER for rent another accommodation of equal value. Furthermore, GECO S.R.L. will be entitled to withdraw from the contract before the start of the rental, or even during, if the delivery of the rented accommodation is impossible due to unforeseen circumstances or a case of force majeure that put the tenant or the accommodation itself in danger or that affect the performance provided to such an extent as to make the fulfillment of the contract reasonably impossible. In this case, GECO S.R.L. will refund the amounts already paid, after possible deduction of an amount for the services already provided. GECO S.R.L. will not be liable for compensation for further damages, in the cases provided for in this point of the General Conditions. GECO S.R.L. declines all responsibility for any changes made by the owner without its knowledge, unless there is impossibility of total or partial execution of the contract and the CLIENT is not interested in the partial execution of the contract. In the event of problems, the CUSTOMER undertakes to do his best to resolve and minimize them, in order to avoid any damage that may result. If he is unable to do so, the CUSTOMER is asked to contact GECO S.R.L. (tel.: +39 055 292786, e-mail: reservation@vacation-rentals.it) confirming the disputes in writing within 24 hours by fax (+39 055 2399124) or by e-mail (reservation@vacation-rentals.it). The CUSTOMER undertakes to grant GECO S.R.L. the time necessary to try to resolve any problem. In the absence of the written communication referred to above and of an explicit authorization
and GECO S.R.L., customers who leave their accommodation before the scheduled date will lose any right to a possible refund of the rental price, unless they have a legal right of cancellation. For any dispute presented after the end of the stay, the CLIENT will not have any right to any compensation. GECO S.R.L.'s liability is excluded for damages that may result from the following causes:
- actions or omissions by the CLIENT or one of the occupants;
- unforeseen or unavoidable failures by third parties who do not participate in the execution of the contractual service (e.g. temporary suspensions or disturbances in the supply of water or electricity, as well as the constant functioning of services such as heating, elevator, air conditioning, swimming pool, TV, internet etc.);
- force majeure or events that GECO S.R.L. , its intermediaries or its auxiliaries (e.g. the owner) could not have foreseen or avoided even if they had used all due diligence;
- use of swimming pools, children's playgrounds, sports equipment of any kind (such as tennis courts, football pitches, gyms or equipment). The use of these facilities is at your own risk;
- damage and loss resulting from burglary;
- noise: even in holiday areas, customers may unexpectedly be exposed to noise from construction work, traffic and the like. Neither the Owner of the property nor GECO S.R.L. can be held liable for disturbances caused by noise;
- swimming pools: if the property has a swimming pool, the CUSTOMER, for safety reasons, is required to follow all instructions regarding the use of the swimming pool given by the owner of the property or by GECO S.R.L. The CUSTOMER is responsible for the use of the swimming pool. It is forbidden to allow minors under 18 to use the pool without the supervision of an adult.
7. ARRIVAL AND DEPARTURE TIMES
Once the balance has been paid, the CUSTOMER will receive the travel documents that must be handed over to the owner or his representative upon arrival. Arrival at the accommodation is possible on the day of arrival at the times indicated in the booking confirmation. If the CUSTOMER is late, he is asked to promptly inform the owner or his representative, who will try to organize the reception even outside of normal hours (possibly upon payment of a fee). In the event that the owner or his representative cannot be contacted and a possible delay cannot be communicated to him, in the event that the delay was not previously communicated or in the event that the owner cannot accept a late arrival, the CUSTOMER must bear the costs of the overnight stay in the hotel. In the event that he cannot take delivery of the object as planned, for example due to impediments caused by the traffic situation, strikes, etc. or for personal reasons, will in any case remain liable for the entire rental price. The same rule will apply in the event that the rented property is returned earlier than expected. On the day of departure, the accommodation must be vacated by the time indicated in the booking confirmation and returned to the owner or his representative clean and in the same conditions in which it was found upon arrival. For any change in the arrival date compared to that indicated in the booking confirmation, a request must be made to GECO S.R.L. . For organizational reasons, in many cases it is not possible to accept the change. If this is possible, written confirmation from GECO S.R.L. is required.
8. OCCUPANCY OF THE ACCOMMODATION
The rented property may only be occupied by the expected number of people (adults and children). If the maximum number of occupants is exceeded, the owner has the right to refuse access to the accommodation or to request an increase in the rental price and additional costs based on the number of excess people.
9. ANIMALS
The accommodations in which pets are accepted are those in which the pet is indicated. The presence of pets, the species and size must in any case be communicated by the CLIENT at the time of booking, even if the description of the accommodation explicitly allows them. The permission is always valid for one animal only. The exclusion of pets from the description does not guarantee that no animal will be found, even temporarily, in the holiday home, tourist village or accommodation booked by the CLIENT. This may be due to the nature of the tourist village, characterised by accommodation owned by private individuals, on whom no impositions can be made in this regard, or to the fact that the owner of a tourist property in a rural region keeps a pet and wishes to avoid conflicts with
n foreign animals. Even if pets are explicitly allowed, they do not necessarily have full freedom of movement. Animals are not allowed in swimming pools and in some cases in green spaces, as well as in restaurants and similar.
10. SWIMMING POOL
The description of the accommodation indicates the presence of a swimming pool and generally indicates its opening period. The start and end of the opening period of the swimming pool may however vary depending on the weather conditions. For swimming pools in residences and tourist villages, opening hours and special regulations established by the respective administrations often apply.
11. BABY COT AND EXTRA BED
The description of the accommodation indicates whether extra beds or cots are available for children. The linen for the cot must be brought by the CUSTOMER. The CUSTOMER is asked to check whether the cot is included in the maximum number of occupants or whether it is possible to exceed, through the availability of the cot, the maximum capacity of the accommodation indicated in the description. Extra beds and cots must in any case be ordered at the time of booking and possibly also confirmed.
12. EXTERNAL MAINTENANCE
If necessary, the owner or his representative reserves the right of access to carry out essential maintenance operations (garden, swimming pool, etc.).
13. JUDICIAL COURT
For any dispute regarding the booking and rental, the place of jurisdiction is Florence. The applicable law is Italian law. Signing the booking implies knowledge of the GECO S.R.L. General Conditions and entails their acceptance without reservations or exceptions. If some conditions of this contract were or become invalid or if a gap should occur in this contract, the validity of the remaining conditions cannot be called into question.
